Terms and conditions of sale
1. Object and scope
These General Terms and Conditions of Sale (GTCS) apply to all orders placed on the website www.3d-mountain.com, published by the company 3D-MOUNTAIN. Any order placed on the site implies the unconditional acceptance of these GTCS by the customer, who acknowledges having read them beforehand.
3D-MOUNTAIN reserves the right to amend its General Terms and Conditions at any time. The applicable General Terms and Conditions are those in force on the date of the order.
2. Seller details
The website www.3d-mountain.com is published by the company 3D MOUNTAIN, SASU with a share capital of €1,000 (variable capital, floor of €100), with its registered office at 5 rue des Myosotis, 63610 Besse-et-Saint-Anastaise, registered with the RCS of Clermont-Ferrand under number 821 564 481 (SIRET 821 564 481 00017), reachable at contact@3d-mountain.com. 3. Products
3D-MOUNTAIN offers for sale wooden items that are engraved, cut, and manufactured in its workshop in France: decorations, 3D relief maps, trophies, personalised gifts, wooden stickers, etc. The essential characteristics of the products are presented on each product sheet on the website.
Certain products are personalised or made to order to the customer's specifications (engraving, text, choice of pattern). The photographs and illustrations accompanying the products are not contractual; as wood is a natural material, slight variations in shade or grain may exist from one item to another.
4. Price
The prices of the products are shown in euros, all taxes included (TTC), excluding delivery charges. Delivery charges will be specified before the final validation of the order.
3D-MOUNTAIN reserves the right to change its prices at any time. Products are charged at the prices in effect at the time of order validation.
5. Order
The customer selects the products of their choice, adds them to their basket, and then confirms their order by following the steps of the checkout tunnel (summary, delivery information, payment). The order is only final after payment confirmation.
A confirmation email summarising the order is sent to the customer at the address provided when placing the order. 3D-MOUNTAIN reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order, or in the event of product unavailability.
6. Payment
Payment is made online, in full, at the time of the order, by bank card via a secure payment platform. The bank details transmitted are encrypted and are never stored by 3D-MOUNTAIN, which has no knowledge of them at any time.
The order is considered definitively validated upon receipt of payment confirmation from the payment provider.
7. Delivery
3D-MOUNTAIN delivers to metropolitan France and the European Union. Products are manufactured and shipped within 24 to 48 working hours of order validation, unless otherwise indicated on the product sheet or communicated to the customer, particularly in the event of high demand or for large volume orders (professional orders).
The actual delivery time, once the package has been dispatched, depends on the carrier and destination; it is given as an estimate when ordering.
The transfer of risk occurs at the moment the product is handed over to the customer. In the event of damage noted upon delivery, the customer must make the necessary reservations with the carrier and inform 3D-MOUNTAIN as soon as possible.
8. Right of withdrawal
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalised.
As all products offered by 3D-MOUNTAIN are manufactured or engraved to order according to the customer's specifications (chosen text, design, dimensions or finishes), They are not eligible for the 14-day right of withdrawal provided for by article L221-18 of the Consumer Code. This exclusion is brought to the customer's attention before the validation of their order.
This exclusion does not prevent the legal guarantee of conformity and the guarantee against hidden defects described in Article 9 below.
9. Legal Warranties
All products sold by 3D-MOUNTAIN benefit without exception, and at no extra cost:
- of the statutory guarantee of conformity (Articles L217-3 et seq. of the Consumer Code), for non-conformity defects existing at the time of the delivery of the good;
- of the legal warranty for hidden defects (Articles 1641 et seq. of the Civil Code), for hidden defects rendering the product unfit for the purpose for which it is intended.
Within this framework, the customer can choose between repair or replacement of the product, subject to the cost conditions provided for by Article L217-9 of the Consumer Code. To avail themselves of these guarantees, the customer must contact 3D-MOUNTAIN at the address contact@3d-mountain.com specifying the order number and the nature of the defect found.
10. Returns and refunds
As the right of withdrawal is excluded for personalised products (see Article 8), a return can only be accepted in the event of a non-conforming, defective or damaged product during transport.
In this case, the customer has 14 days from receipt to report the issue to contact@3d-mountain.com, with supporting photographs. After validation, 3D-MOUNTAIN will, as appropriate, replace the product or issue a refund.
When the return is due to an error or defect attributable to 3D-MOUNTAIN, the return costs will be covered by 3D-MOUNTAIN. In other cases, the return costs will remain the responsibility of the customer.
11. Responsibility
3D-MOUNTAIN shall not be held liable for damages resulting from improper use of the product, force majeure, or the actions of a third party (particularly the carrier). 3D-MOUNTAIN's liability shall not extend beyond the amount of the relevant order.
12. Intellectual Property
The creations, visuals, patterns, and engravings offered by 3D-MOUNTAIN remain the intellectual property of 3D-MOUNTAIN, unless otherwise agreed. The client who provides a visual or text for customisation guarantees they hold the necessary rights to this content and assumes full responsibility for it.
13. Personal data
Our commitment to the customer's personal data processing in the context of their order is described in our privacy policy.
14. Disputes and mediation
In the event of a dispute, customers are requested to first contact 3D-MOUNTAIN customer service at contact@3d-mountain.com in order to seek an amicable solution.
In accordance with Articles L616-1 and R616-1 of the French Consumer Code, in the absence of an amicable resolution, the consumer client may have recourse free of charge to the following consumer mediation service: [TO BE COMPLETED — name, address and website of the consumer ombudsman].
These GTC are subject to French law. In the absence of an amicable resolution, the French courts shall have sole jurisdiction.
